I have a very successful Denver DUI practice. To find someone guilty, the jury needs to be without any reasonable doubt that the person is guilty. I look at three aspects of the facts to establish reasonable doubt in the minds of the jury members:
- Initial stop: To stop someone for DUI, the officer must have reasonable suspicion for the stop. I work to establish that the officer lacked this reasonable suspicion for the stop.
- Roadside testing: I have experience with the roadside tests: HGN, walk and turn, standing on one leg, etc. — And if you, as my client, profess your innocence, then I attempt to convince a jury that the manner in which you performed the DUI maneuvers did not establish beyond a reasonable doubt that you were intoxicated. These maneuvers are not easy for sober persons to perform under no pressure situations. But imagine how difficult it is when 2 police officers are standing in front of you, often with guns on their hips, in the dark of night and the temperature sometimes below freezing, and the officer instructs you to perform a nine step forward nine step back maneuver along an imaginary line on sloping and uneven terrain … Well, you know that you are not drunk but you are nervous and cold and you start performing this little athletic endeavor as best you can and when you finish the Officer shakes his head and you hear him say, "I'm taking you into the station." Then suddenly your arms are behind your back and the cold sound of the hand cuffs snapping ... Now your nightmare begins in earnest. That's when, if you are wise, you had better get an experienced lawyer to protect your interests.
- Breath or blood testing: There are a lot of things that can go wrong with these technical tests so it is especially easy to create a reasonable doubt in the minds of the jury members in this area.
Types of DUI Defense Cases
There are a few different types of DUI or DUI-related cases in Colorado:
- DWAI — Driving With Alcohol Impairment: blood alcohol content (BAC) is more than .05 percent but below the level for DUI
- DUI — Driving Under the Influence: BAC is .08 percent or more
